Vehicle-Related Safety Practices
GEN (a) Children shall never be left unattended in a vehicle.
(b) Children shall be accepted and discharged from the curbside of the vehicle.
(c) The interior and exterior of each vehicle shall be maintained in clean
and safe condition, with clear passage to operable doorx "doors:vehicle"s.
I/T (d) All vehicles that are utilized to transport children below 18
months of age shall be equipped with car seatsx "infant/toddler programs:car
seats" (child passenger restraint systemsx "child passenger restraint
systems") that meet Federal motor vehicle safety standards, in accordance
with provisions of DMVx "Division of Motor Vehicles" law, pursuant
to N.J.S.A. 39:3-76.2a.
EC (e) The driver shall not transport more persons, including children
and adults, than:
- The occupancy of the Type I School Busx "school bus:maximum
occupancy", as indicated by the vehicle manufacturer; or
- The occupancy of the Type II School Bus or School Vehicle or other
approved vehicle, as determined by the number of operable seat beltsx "seat
belts".
(f) The driver of and/or additional adult(s) on the Type I School Bus shall ensure
that:
- All passengers are seated and remain seated when the bus is in motion;
and
- I/T 2. All passengers below 18 months of age are secured in the proper
restraint system, as specified in (d) above, when the bus is in motion.
EC (g) The driver of and/or additional adult(s) on the Type II School Bus,
School Vehicle and private passenger vehiclex "passenger vehicle" shall
ensure that:
- All passengers are seated and remain seated when the vehicle is
in motion; and
- All passengers are secured in an operable seat beltx "seat
belts" or proper restraint system, as specified in (d) above, when the
vehicle is in motion.
GEN (h) There shall be no standees in any vehicle transporting children.
(i) The driver shall conduct two emergency evacuationx "emergency evacuation:from
school bus" drills each year for passengers who ride the Type I or Type
II School Bus.
(j) The driver shall conduct a daily check of the vehicle, which shall include
all safety equipment, to ensure that the vehicle is in sound operating condition.
(k) The driver shall conduct a check of the vehicle, after each run is completed,
to ensure that no child has been left on the vehicle.
(l) Smokingx "smoking, prohibited" shall be prohibited in all vehicles
when occupied by children.
EC (m) For early childhood programsx "early childhood programs:discharge
of children from vehicle", the driver or additional adult(s) shall ensure
that each child discharged from the vehicle is received by his or her parentx
"parent:receiving child discharged from vehicle" or person designated
by a child's parent.
SA (n) For school-age child care programsx "school-age child care
programs:discharge of children from vehicle", the following shall apply:
- When children are being transported in a vehicle other than a Type
I School Busx "school bus:discharge of children from" or Type II
School Bus, the center shall comply with one of the following options:
- i. The center shall ensure that each child discharged from the vehicle
is received by his or her parent or person designated by the child's parent;
- ii. The center shall ensure that each child is boarded onto and discharged
from the vehicle on the same side of the roadway as the child's home or
other destination or point of origin; or
- iii. The center shall have one adult on the vehicle in addition to
the driver who shall accompany each child when crossing a roadway upon
boarding or when being discharged from the vehicle.
- When kindergartenx "kindergarten:discharge of children from
vehicle" or pre-kindergarten children are being transported in a Type
I School Bus or Type II School Bus, the center shall comply with one of the
options specified in 1i, ii or iii above.
