Section 418.17
Transportation

(a) The provider must obtain written consent from the parent of the child for any mechanical transportation provided by or arranged for by the provider to children in care at the day care center.
(b) A staff member must never leave a child unattended in any motor vehicle or other form of transportation.

(c) Each child must board or leave a vehicle from the curb side of the street.

(d) Any motor vehicle, other than a public form of transportation, used by the provider or by any substitute, employee or volunteer to transport children in care at the family day care home must:

(1) prominently display an unexpired certificate of inspection issued by the New York State Department of Transportation;

(2) have a current registration; and

(3) be operated by an individual who is at least 18 years of age and possesses a valid New York State driver's license.

(e) Any motor vehicle, other than a public form of transportation, used by a volunteer to transport children in care at the center must:

(1) have a valid inspection sticker;

(2) have a current registration; and

(3) be operated by an individual who is at least 18 years of age and possesses a valid New York State driver's license.

(f) Any motor vehicle, other than a public form of transportation, used by staff of the center to transport children in care at the day care center may be operated only when:

(1) all children are seated and secured in age-appropriate safety restraints;

(2) the number of persons occupying the vehicle does not exceed the number of safety restraint assemblies in the vehicle as installed by the manufacturer; and

(3) all doors of the vehicle are securely closed and, if the doors are manufactured with locks, locked.
