Licensing Standards for DayCare Centers
(1) Annual License - An annual permit issued by the Department to a child welfare agency, authorizing the licensee to provide child care in accordance with provisions of the license, the law, and requirements (rules) of the Department. Issuance of a license is not an endorsement of child care methods or of an agency's operational philosophy. A license is not transferable from one location to another or from one licensee/operator to another. The license may be revoked at any time upon 90-days notice to the licensee, or if the health, safety, or welfare of the children in care imperatively require it may be summarily suspended. (2) Applicant - The person or entity seeking a new or renewed license. (3) Application - The form for and process of applying for a new license or the renewal of an existing license. (4) Application for Renewal - Application for a new annual license during the existence of a current license. (5) Board of Review - The entity designated by T.C.A. ¤¤ 71-3-508 through 71-3-512 to hear the appeals of denials or revocations of licenses of child welfare agencies licensed by the Department of Human Services. (6) Child Welfare Agency - Child caring entity as defined in T.C.A. ¤ 71-3-501. (7) Commissioner - Executive head of the Tennessee Department of Human Services. (8) Compliance - The adherence to all licensing requirements by a licensee or an applicant for a new license. The period of compliance shall be the time frame given by the Department to a licensee or applicant for meeting licensing requirements prior to revocation or denial of a license. (9) Conditional License - A permit issued by the Department to a new child welfare agency or to a new child care system central operator or to such persons or entities making reapplication, permitting and authorizing the licensee to begin child care operations. It is valid, unless suspended, for 90 days or until the application for an annual license is finally determined, and is issued upon application or reapplication by the operator only if the staff and facility do not present any apparent hazards to the children that may be in care and only if the facility has received fire safety and environmental sanitation approval. If, at the end of the 90-day period, evidence is provided by the applicant licensee that such child welfare agency is suitable and properly managed and that the agency is in compliance with the rules governing the applicable class of child welfare agency, the Department will issue an annual license to the child welfare agency. (10) Denial - The decision of the Department of Human Services not to issue a conditional or annual license. (11) Department - Tennessee Department of Human Services. (12) Law - The statutory or regulatory provisions (rules) affecting the operation of a child welfare agency. (13) Licensee - The person, agency, group, or entity to whom or to which a license to operate a child welfare agency is issued by the Department of Human Services. (14) Reapplication - Application for a new license following the denial or revocation of a license. (15) Revocation - The permanent removal of an existing annual license. (16) Suspension - The temporary removal of a license for violation of licensing laws or regulations or other factors immediately affecting the health, safety, or welfare of children in the care of a child welfare agency.
