I have two false charges that were filed against me by my abusive husband. I was in a domestic violence situation but am no longer in danger.

When I finally got the courage to stand up to him by verbally telling him I wasn't going to take his abuse anymore, he retaliated by filing charges against me! Long story short, he asked the police to escort me out of the house at midnight with nowhere to go! I told the police that I would rather be arrested than be a female outside after midnight, which is dangerous and VERY scary. I allowed the arrest to happen because I was scared but was charged with violating a protective order, which was dismissed a few weeks later. I was also issued a final protective order because I tried to contest the charges, which is ridiculous! Luckily, I asked for another hearing and the judge ruled in my favor.

Now, the violation of the protective order has been dropped, which can be expunged, and I also had the final protective order dropped, which can only be shielded. As far as I know, a shielded, non-conviction still shows up on a background check for children. Again, both of them are false and were initiated by my husband.

The problem with this situation is, I love working with children and I am excellent at it! Will I be barred from the job I love? I have a job recommendation letter and several references. Even with the recommendation letter and references will I be prevented from working in this field? The final protective order was dismissed and shielded but is my career really over?

By the way, I live in Maryland if anyone is familiar with the laws here.

It’s going to depend on your state. Where I live, in California....it might be hard to get licensed as a home provider, but you’d probably be able to work in a center or preschool. The first thing I’d do, is order a live scan and background check of myself just to see what shows up.

It isn't that easy to get a protective order in the first place, that will be your first hurdle. https://www.peoples-law.org/protective-orders

Two charges following qualifying for that order may make working in this field really tough for you. Maryland views you as the abuser. Have you spoken with a lawyer yet?

Please read my post again. I do not have two orders of protection and protective orders are in fact extremely easy to put in place. In fact, they are put in place quite frequently and the court system is well aware that some people put orders of protection in place in retaliation during domestic disputes. However, the courts still have to take all of these matters seriously for obvious reasons.

But back to my question, I was not asking for legal advice. I'm actually asking about the possibility of working in the field that I love, and am very good at, after the allegations which have been placed against me, and which are civil not criminal.

Cat Herder, your link is not a direct response to my question. Instead it is a licensing statement from the Office of Child Care. I am not sure if you are indirectly trying to imply that I will not be able to work in the field or if you are just unsure about the outcome of my job inquiries.

If there are others on this forum who may be able to give a more direct answer, that would be helpful. My original post outlines my dilemma in detail. Thank you everyone.

Just to further clarify, I currently have no charges against me nor was I ever guilty of anything. I had one charge against me, which was dropped, and I had an order of protection against me, which was also dropped after my husband admitted in front of the judge that the charges were false.

Again, I now have no charges, nor was I ever guilty. The reason or my original question is that court records still show up on a background check and I am wondering if that will bar me from the field.

My original post states the details of my question and what happened.

Wow... ask for help/assistance and then get rude with those that try to help you.
Your hostility suggests there is more to the story than what you are posting....

So my advice is to contact Maryland licensing and ask them. (Use the link Cat Herder posted. )

They WILL and DO know the answer to your questions.

Cat Herder was merely taking time from her busy day to offer you FREE advice.... just to be treated unkindly.

Doubt you will get further assistance from anyone here.

I hope your "skills" with children are much more kind and friendly than you've demonstrated here.

Wow, not sure how this conversation turned south or how my post was rude. It seems that my words were taken out of context due to this conversation being online as opposed to being able to see or hear my voice or facial expressions.

Anyway, the reason I came back to this thread is to post some positive news! I found out from the board of education and from the Criminal Justice Informational Service that background checks only search for criminal offenses not civil matters. Thank goodness because that would be extremely unfair and could bar a lot of people from employment. Since I have no criminal charges, nor am I engaged in any such activity, I will be fine.

The reason for my original question was that I was hoping someone would be familiar with the background check process. Of course I could have searched directly but thought this forum would be easier.

Hopefully my final response will be helpful for others searching for similar information. Clearly situations like this can lead to misconceptions about people.

Cat Herder, after reading your post again I see the link you posted. I didn't see that post earlier probably because it was so early in the morning and I hadn't fully woken up yet. I also called the Maryland State Department of Education and spoke with someone in charge of processing background checks. The link you provided was to the ccredentialing program which is a different department. By the way, I am not trying to be rude in any way by mentioning that. I only point it out in case you ever encounter someone asking a similar question.

Ummm she's been here forever and is a highly educated, skilled, and frankly quite famous up in here.

I love when something new pops up in a post. Cat being a troll. .. not exactly what I enjoy but I will give you some cred for it being unique.

Might want to apologize cuz she could end up being your bestie in if you are a newbie and can't mange through the very beginning without trying to take a shortcut via our expertise.

I have not been quite as busy as you, recently. No worries, you will catch up.

I really did think the legal non-profit ("supported by Maryland's non-profit legal services providers, Maryland pro bono attorneys, and the legal academic community.") from her state and state info would answer her questions. I am at a loss, here. Hopefully when she is less stressed she will read it all as intended.

Back to the OP 's question....With that history, if you we or weren't innocent, I would err on the side of caution and not hire you. I have kids to protect.

I turned in an employee of a center in my town due to her getting arrested for domestic. She claimed innocent / misunderstanding/ not my fault blah blah blah....anyways Childrens safety comes first. Her hubby worked with my ex. It was true. She got fired.

Misunderstanding in domestic are a ticking time bomb IMO.
