Default Wording Please for Contract

Hi all,

Some time ago, there were some great posts for contracts. Hoping you can share them again. I need specifically something about:

if you do not pay your child care, or do not give adequate notice, and I have to take you to small claims court, it will include.....late fees, court costs,....what else.

Here is mine:


Payment Procedures
All payments are due weekly by 5:30 P. M. on Fridays for the following week.
After 5:30 p.m. The late fee will be assessed. ($10.00 per day) If payment and late fees are not paid on Monday morning, your child will not be accepted into care till payment, including ALL late fees is made.
I ask you to consider how you would feel if your employer came to you on your expected payday and told you that your paycheck would be delayed???
If a period of one week passes without payment received, the contract will be terminated, the position filled and the collection process begun. You will be responsible for any costs related to collections of the childcare fees.
All fees are CASH ONLY. I do not accept checks!!

Trial Period
All new children will be cared for on a two-week (14 calendar days) trial period beginning on your child’s first actual day of care. During that time the parent or provider may terminate the childcare agreement with 24 hours notice. After the trial period, a two-week WRITTEN NOTICE is required by parents to terminate the agreement (See Termination Policy).


Termination Policy
Provider may terminate the contract at will without notice.
You are required to give two-week’s written notice when you decide to terminate child care. Termination letters are accepted on Fridays only. The two weeks will be paid in full, regardless of whether or not your child is in attendance. If it should be necessary to go to court over nonpayment of fees owed for services owed to provider plus all late fees (until bill is paid) court and attorney fees will be added on to your bill. Termination notice will not be accepted while provider or parents are on vacation.

should legal action be necessary to settle a monetary dispute, you will be liable for, but not limited to; the original deposit, costs of preparation and delivery of this notice, compensation for loss of income, as well as any and all legal fees incurred by me.

Payment
Payment is based on your contracted hours, not on hours of attendance.It is required that you pay in advance of care. Payment is due in full on Friday for care the following week. Do not leave payments in my mailbox, in your child’s diaper bag, etc. Please hand payments to me directly.

If full payment has not been received by 1 p.m. on Monday, it is considered late and the late payment fee will be assessed. The late payment fee is $10 per calendar day per child. Late payment fees will continue to accrue until payment is made in full. If full payment is not made by Wednesday, childcare will be temporarily suspended and your child WILL NOT be accepted into care until payment (including all late fees) is received. If a period of 5 calendar days passes without payment, your contract will be terminated and the collection process will begin. You will be responsible for any and all costs related to the collection of unpaid childcare fees.

If your childcare account remains unpaid for any reason, be advised that your account may be reported to ProviderWatch. ProviderWatch is a childcare credit reporting agency. Your delinquent account being reported to ProviderWatch will likely affect your ability to find childcare providers willing to accept your children until any such accounts have been paid in full. You may contact ProviderWatch if any childcare provider informs you that their decision not to accept your child into care is based in whole or in part on information received from this agency. ProviderWatch will disclose any delinquent account information on record so that you may resolve these accounts.

Tuition & Payment Due Date
Parents will pay at least one week in advance. The childcare fee will be $***.XX per week. Fees are due on Friday each week for the following week of care. If this day is a holiday, payment is expected on the previous day. If the client uses vacation days, payment is due BEFORE the client leaves. Payment is still expected if the child is absent unless other arrangements have been previously made. If the provider uses vacation days, payment is due BEFORE the provider leaves. If this day is the provider’s personal day, payment will be expected at drop-off on your child’s first day back. Checks should be made out to [insert name here] and must be dated for the day they are due. Post-dated checks WILL NOT be accepted.

Rate Increases
Rates will be reviewed periodically and may be adjusted to reflect increases in operating costs.

Late Payments & Insufficient Funds
You will pay a fee of $10 if you fail to make a payment on the scheduled day. If payment is not received by drop-off time on Monday, childcare services will not be provided until payment and any applicable late fees are paid in full. Repeated late payments or NSF checks may be grounds for immediate TERMINATION. You will be liable for any and all costs of collection with regard to delinquent tuition fees. Any fees related to insufficient funds check must pay any bank charges to my account. After one NSF check, you may be required to pay your weekly tuition by cash.


I'm not sure about the "Post-dated checks WILL NOT be accepted."
