Thanks to all of you who have reached out here and privately to inquire and offer support in regards to my recent Terminated Parent Nightmare! It has really helped me to not feel so alone in all of this!
So ... update? The disgruntled mom who filed the case against me has agreed to have the matter heard on Judge ****, as did I - so we film in Los Angeles on the 14th of this month. I was asked to provide a statement of my side of the story prior to going on the show, which I did, and we shall see what happens from this point forward.
I could win ... and I could lose - but no matter what she decides or says to either of us - that chapter in particular will be over on that day. Yahooooo!
SO ready to move on!
In regards to the licensing citation I am still trying to appeal, I have continually called the Southern California Child Care Law Advocate and her voicemail is still full and she is unreachable. I just don't understand how someone can leave their position for months at a time without a specified return date and no replacement. I was told by her office that she was scheduled to return toward the end of October. I am feeling frustrated to say the least.

I will keep you guys posted. The producers of the J.J. show said that the episode likely won't air until early next year sometime. If I win, I'll tell ya the date ... if I lose ... well ... Ha, ha, ha! Just kidding! I will tell you the date even if Lady Law decides to annihilate me! I did what I felt was best in the situation - win or lose!

My only advice is to make sure you have lots of documentation, make sure everything that can be is notorized. I've seen where she won't accept anything that isn't notorized.

also print out any emails or document any texts, print out your phone bill if you must to prove times and dates of contact, copies of all your daycare enrollment documents, document like crazy.
i cant wait till you win!!!! I will be outraged and so confused and shocked if you dont win.

We are not allowed to bring any statements, notarized or not, because they can't be cross-examined, BUT - I am bringing a witness who is the Dad of one of my daycare kids who is the exact same age as the child who was terminated. He has seen and heard the interaction between myself and the suing parent, seen the child's outrageous behavior and can speak to how I treat the children in our care - so I feel good about that.
I will have all my other ducks in a row, but we literally get 12 minutes in the courtroom so I am expecting short and sweet!

Thanks for the update. I agree and hope that you follow eveyrone's advice and document, document, document. Print EVERYTHING that you can and make a journal of everything in cronological order. Organize everything in groups ... emails, phone calls, texts, letters, contract, policy handbook etc. Really focus on what your standpoint is and get as much "evidence" as you can that can support your case. Get some of those little stickly flags and bookmark the parts in the handbook, contract, emails etc that support your case and highlight the parts. The more organized you are the easier it'll be for you to get your proof to Judge *****.
I'm sure you'll do fine. Please let us know how it turns out once you're back. If you win (which you probably will) then you can finally have that validation ... if you lose your case (which you probably won't) well at least the show pays the client and it doesn't come out of your pocket. In either case at least it can all be put behind you.

good idea!
plus documentation about yourself personally....background check, reference letters from other parents (if you do those), training and education, record of your past with licensing (showing no issues before this)
I hope they don't tell you that you have to keep the verdict a secret until the episode airs!! That's what they do to people on shows like Survivor. I know Judge ***** show isn't as huge as Survivor, but jeez.... I can't stand not knowing for that long!!!

also, check the web and make sure (google it) that there isn't anything negative about you because you never know.

I think you certainly already have all your ducks in a row; and I will be completely horrified and baffled if you do NOT win!!!
It is a very sad day for daycare providers when a provider gets sued for giving a child multiple timeouts in one day when the child was being physically violent to the other children. It is absolutely crazy to me!! The only other alternative would have been to call the parent immediately after 1 timeout to come pick up their misbehaving child.

I think your chances with Judge ***** will be better then with another judge even. She's pretty "old school" and I'm sure would find the thought of no consequences at all for kids absolutely ridiculous too!
The whole ordeal is ridiculous and I can't wait for you to be able to put it BEHIND you! My husband rolls his eyes every time I bring this up because "that parent is so ridiculous!"

Oh I just thought about something ... be prepared for the DCP to say that you were somehow neglecting or abusing the kids. If you have any written letters, emails or texts from this family and the other families that talk about how wonderful your daycare is or how much their child loves coming to daycare then take these too (write telephone numbers on them just in case).
Be prepared to point out that behavior issues were an issue that was being worked on and that if you had been abusing or neglecting the children then they would have pulled the child way before now. If they bring up abuse or neglect just emphasize that the only thing that youhave ever done that could somehow be related to abuse is putting the child in time out which is not abusive. Make sure that you say how long the child was in time out for and the reason why the child was put in time out that particular time. You can even bring up the thought that you had the other children to look after and that since the child was not cooperating that you had no choice but to separate him from the other children to prevent him from hurting/disrupting the other kids.
I hope they don't go this route but you just never know.

I had to look up the show to really understand what is going on here..
so the show is about a lady who is a judge correct? And is she a real judge that can make a real decision on this case? Or is it just for show on TV and then they go to see a real judge?

She's a real life judge and makes decisions right there on the case! She's rude at times, straight forward and someone you don't want on your bad side.

Yes one for the providers! We needed someone to have a victory on our side. So many parents try to pull stunts like this all the time and think they can get away with it. A parent tried this with my sister who has been doing home daycare for 30+ years and even with as far as contacting civil rights to try and get her in trouble because she was terminated and owed a balance. She tried to play the race card and mistreatment. Well when her licensing worker came out and did her investigation (mind you this is the same worker she has had for the past 14 years so she knows her and how she runs her daycare) she reported back to them and busted the parent for being a liar and trying to cause trouble. We don't know what they said to her, but she ended up calling the worker and apologizing for starting all the trouble.
