I'm considering starting a home daycare, and would primarily use our finished basement. However, the previous owners did the basement work, and I don't believe there's a certificate of occupancy for the finished basement due to low ceiling height - will this prevent me from using the space for daycare? Is there any way to get a variance?

Advice, please?

Please review the following docs on basements in NY and Daycare. You have requirements on ceiling heights, egress requirements, etc... Review carefully. I wanted to use my basement, but did not meet the minimum height requirement as they measure from the floor to the lowest item at the top which is not necessarily the ceiling. It can be support beams or heating pipes, etc...
