Unhappy School Age Children in DayCare

State: Texas
Children: Boy 6yr, Girl 10Yr

My children live with there mother in a different city. There Public school has Year round schedule (I think thats what it is). They have a 1 week intersession every 6 weeks. I am trying to arrange to have them during that period. I was told that they cannot be in a child care facility during a school period as they are school age. Can some one explain is this correct? for registered care only?
